This Purchase contract is made available online for your viewing. This is not a form, you are not required to fill out this contract. If you choose to purchase a puppy/dog from us, we will fill in this contract with the appropriate information. You will receive a copy of this contract with your puppy/dog.
This puppy is a purebred German Shepherd Dog, registerable with the Canadian Kennel Club and an individual application is pending and shall be available at no additional charge to the purchaser. Upon execution of this contract, the seller does hereby convey title and interest in the described German Shepherd puppy to the buyer (except for the terms listed herein).

GENERAL PROVISIONS;
1. The Seller agrees to sell and the Buyer agrees to buy a __ male or __ female puppy from the above described litter. (check appropriate line)
2. The Seller agrees to sell and the Buyer agrees to buy a __ Companion or __ Show Quality prospect puppy from the above described litter. (check appropriate line)
3. The following representations and conditions apply to the sale
of the aforementioned dog:
______a) As of the date of this agreement, the dog is in good health and
free of communicable diseases to the best of our knowledge.
______b) The Buyer has 3 working days to have dog examined by their own veterinarian and to personally inspect the dog. Any claims must be made within this time period and will be verified by Seller's own veterinarian. A health certificate must be sent to breeder within 7 days following examination to activate this agreement.
______c) Buyer may return puppy to Seller for a full refund (minus deposit) for any reason within the first 72 hours or THREE days of purchase, providing Buyer agrees to prepay all transportation costs to Whispawillow Kennels. After 72 hours buyer accepts full responsibility for temperament and physical well-being of said pup/dog.
______4. Ownership of the puppy/dog will be transferred to the Buyer for the sales price of $_________ to be paid as follows:
$ 200.00 deposit on execution of the Agreement. Be advised that this deposit is Non-Refundable and represents a serious commitment on the part of the Buyer in purchasing the puppy, and this puppy will no longer be available for other prospective buyers. The balance of $________(in cash, certified check, e-check or money order) to be paid on or before the puppy/dog leaves the Seller's premises. If the balance is not paid by ___________________, this Agreement shall be canceled. No refund will be given on any monies received.
______5. If Buyer requests delivery, it shall be by airfreight, PREPAID by the BUYER to a designated location. Buyer is solely responsible all costs of crate, insurance during shipment, and cost of freight charges as well as a $50.00 transport fee to the airport payable at time of purchase. If Seller has to purchase crate prior to shipping, Buyer shall reimburse Seller in full for this cost prior to shipping.
Definitions of Quality
Companion "Pet" Quality: Some pets in this category are beautiful structurally. A male might be a pet because he does not have two descended testicles and therefore would not be guaranteed to have them descend. Some pups may have an an over or under bite, perhaps a missing tooth and therefore would not be guaranteed to correct itself. All our dogs regardless of sex and structure are intelligent and have been bred for excellent temperament and trainability. We do not allow a pet dog to be used for breeding. From time to time we will place a show quality puppy as a companion, these occasional show quality pups are subject to a non breed agreement.
Show Quality: A showable dog goes beyond the definition of pet and is free of all disqualifying and serious faults. With the proper conditioning, training and professional handling this dog should do well in the conformation ring. However this dog is in no way guaranteed to win in the show ring. Structurally he/she embodies the basic type of the German Shepherd Dog and is better than average in quality and appearance. We advise that you seek professional advice for proper show training and handling.
Puppy sold as Show Quality
______6. (Show Quality): If the puppy/dog has been sold as "Show Quality" Buyer agrees that this animal is subject to a CKC non breed agreement until at least 18 months of age, x-rayed and certified clear of hip and elbow dysplasia by the OVC or OFA, is of sound temperament, is in good health and free of communicable diseases. The cost to lift CKC non breed agreement is at the buyers expense.
Puppy sold as Companion Quality
______7. (Companion): If the puppy/dog has been sold as a "companion" or commonly referred to as a PET, it is NOT to be used for breeding (no exception). In such a case, Seller shall receive evidence provided by a licensed Veterinarian that the puppy/dog has been spayed/neutered within 8 months of date of purchase unless other arrangements are agreed upon by seller in writing.
Buyer agrees that he/she is not acting as an agent in the purchase of this puppy/dog and that the Buyer will not sell this puppy/dog or its progeny to any agent, pet store or guard dog business.
If there are any further guarantees they must be in writing and included with this contract.
RETURN AGREEMENT;
_____ The buyer agrees that if he/she is unable to keep this German Shepherd, he/she will not sell, give away, or otherwise dispose of this dog without first contacting the breeder, who will either accept the dog back on a return basis (some conditions apply) or we will try to assist buyer in finding a suitable alternative home for the dog. If this dog is returned to the breeder the CKC registration papers and vaccination records must be surrendered at that time (no exceptions). This does not imply a financial commitment on the part of the breeder.
If said dog is returned to Whispawillow Kennels for any reason other than a claim against this agreement, the dog must be up to date on all vaccinations, deworming and tested negative for Brucellosis prior to re-entry into the kennels. A boarding fee of $15/day will be implemented. Boarding fee will not exceed original purchase price of said dog. All CKC transfer fees, and vaccination/deworming requirements as well as health certificate will be taken off the amount payable to the original buyer 2 weeks after the resale of the puppy/dog.
_____ Under no circumstances may this dog be disposed of or surrendered to a Dog Pound, Humane Society, Animal Shelter, any Rescue Organizations, Pet Store, other Breeder, or to an individual associated with a suspected or proven puppy mill.
LIMITATIONS OF CONTRACT;
_____1) This contract applies to the original puppy only and is nontransferable to a second party. No replacement puppy will be given if the male or female has been bred. Buyer is responsible for transportation costs to and from Whispawillow Kennels on original and replacement puppy. Whispawillow will not pay for shipping on returned or replacement puppies. Replacement puppy will only be granted if said dog is found to have hip or elbow dysplasia or a genetic condition that will lend the dog to a life of pain and suffering
______2) In the interest of protecting the German Shepherd breed and not contributing unnecessarily to the problem of pet overpopulation, Whispawillow Kennels will only sell companion puppies on CKC Limited Registration. CKC Limited Registration means that the dog is registered but no offspring of an animal with limited registration will be accepted for registration with the Canadian Kennel Club (CKC), and puppies may not be sold as purebred.
HEALTH GUARANTEE;
Hip Dysplasia is a congenital malformation of the ball and socket joint of the hip. A dog may or may not become lame because of the disease and depending upon its severity.
Every reasonable precaution has been taken to prevent this puppy from acquiring hereditary hip dysplasia or elbow dysplasia. Due to the unknown hereditary and environmental causes of such defects, no guarantee will be given against them. However, should this Puppy be diagnosed between 8 months and 26 months by a radiologist or qualified veterinarian, with "crippling" hip or elbow dysplasia through x-rays, the Seller reserves the right to have the x-rays sent to the Orthopedic Foundation for Animals (OFA) report, or rating report by the Ontario Veterinary Association (OVC) for a second opinion at owners expense, if dysplasia is confirmed the Seller will:
Companion puppy
______(a) In the case of a Companion puppy, if the said dog is diagnosed with crippling Moderate to Sever hip or elbow dysplasia, breeder will provide Buyer with a suitable replacement companion puppy as soon as such a puppy is available to Seller within 12 months of confirmation of diagnosis. Decision regarding replacement will remain at seller's discretion, based on availability of puppies. If the buyer chooses to keep the original puppy, buyer must provide written verification that the dog has been spayed or neutered within 30 days of diagnosis. No replacement will be given if the dog is not examined by 26 months. This replacement policy applies only to the original buyer. If the buyer does not choose to keep the puppy it must be spayed prior to placement at buyers expense or put to sleep, in which case a certificate of death must be supplied prior to refund or replacement. No replacement will be granted on boarder line or mild dysplasia or for a grade 1 elbow dysplasia on companion puppies. (These conditions are not typically crippling and the dog can lead a normal life in the average companion home)
Breeder must receive a digital image or copy of x-rays before replacement is considered, no exceptions.
Show puppy
______(b) In the case of a Show puppy. If the buyer has the dogs hips or elbows x-rayed between 18 to 24 months and the x-rays sent to OFA or OVC and the dog does not receive an OFA/OVC number for reasons other than the quality of the x-ray.
i) Breeder will provide Buyer with a replacement Show quality puppy as soon as such a puppy is available to Seller within 12 months of notification. Buyer must provide written verification by OFA or OVC.
ii) No replacement will be given if the dog is not examined by 26 months, or if the dog/bitch has been previously bred or used for stud. This replacement policy applies only to the original buyer.
PLEASE NOTE (Companion or Show): Pups prelimed with borderline dysplasia in one or both hips prior to 12 months will require re-evaluation by OFA or OVC between 18 and 24 months before consideration for replacement will be granted: Breeder must receive a digital image or copy of x-rays before replacement is considered.
In either of case (a) Companion puppy or (b) Show puppy above, Whispawillow Kennels will not be responsible for any veterinary charges or other expenses incurred nor will Whispawillow Kennels pay for any transportation or associated charges for the replacement puppy.
IMPORTANT SPECIAL NOTE:
(Companion or Show puppy)
If the pup/dog is used heavily for agility, open obedience, or any other strenuous activity including road working, quad working or forced jogging by treadmills or the opposite extreme and is restricted to a travel crate for prolonged extended routine periods of time without easy regular exercise resulting in underdeveloped muscle tone prior to being 12 months of age, environmentally induced hip or elbow dysplasia and other joint problems may develop. If these factors are factors in diagnoses, it is left to the breeder's discretion to honor this agreement. Breeder may reserve the right for the prompt return of said dog before a replacement will be granted.
The buyer should educate him/herself to proper nutrition and exercise of a large breed dog so as not to induce joint problems by either lack of nutrition or by causing an overweight condition in a developing dog or by over exerting the dog.
MAINTENANCE;
______(1) Buyer agrees that the puppy will reside at the home of the Buyer, have access to a fenced yard, not be chained or "tied out", or left alone in a backyard or kennel only and will be provided with proper housing, and exercise. Buyer also agrees that this puppy/dog will not be used as a guard dog for any business. This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family.
______(2) All Buyers agree that at least one (1) basic obedience training course will be completed with the puppy/dog within the first 6 months of purchase. Copy of certificate to be sent to breeder upon completion. (if classes are not available due to geography let us know and we will work with you)
______(3) Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and - where suggested by a vet - heartworm preventative medication.
______(4) Buyer further agrees to provide proper exercise as indicated in order to maintain this dog or bitch in proper weight and physical shape. A proper diet consists of top-quality Premium dog food, certified by AFCO or CVA
All expenses regarding the animals including: shipping of the animals, proper care, veterinary fees, housing, lifting of a non-breeding contract, or legal liabilities are the responsibility of the buyer at whose home the animal will reside.
_____ Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller, and no refund of any monies.
This Agreement is made and signed by both parties to insure the well being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.
